Cases of Swiss franc bank loans

Our Law Firm provides legal assistance to persons who have loan agreements indexed or denominated in Swiss francs (CHF). We represent borrowers in disputes with banks regarding the validity of concluded agreements, the principles of loan settlement, as well as the recovery of overpayments and reimbursement of benefits.
Legal assistance provided by the Law Firm includes in particular:
• analysis of the loan agreement in terms of the existence of abusive clauses and the possibility of questioning its validity,
• preparation of complaints and requests for payment, constituting the basis for commencing negotiations with the bank or court proceedings,
• representation of the client in negotiations with the bank and possible mediation or settlement proceedings,
• conducting court proceedings against banks, aimed at:
• cancellation of the Swiss franc loan agreement in whole or in part (the so-called 'defrancization' of the loan agreement),
• seeking reimbursement of benefits unduly collected by the bank (installments, interest, commissions, insurance, etc.),
• determination of the invalidity or ineffectiveness of individual contractual provisions (indexation and conversion clauses),
• Defence against a claim directed by the bank in connection with the loan agreement.
The Law Firm bases its activities on the current case law of common courts and the Court of Justice of the European Union (CJEU), taking into account the developing line of case law regarding unlawful contractual provisions (abusive clauses) and the effects of their occurrence in loan agreements.
We conduct clients' cases from the moment of the first analysis of the agreement, through pre-trial proceedings and negotiations with the bank, to representation before courts of all instances. If necessary, we also take action in the field of enforcement proceedings, securing claims or deleting the mortgage from the land and mortgage register.
Swiss franc loan cases require a detailed legal and financial analysis. Our Law Firm provides an individual approach to each case, taking into account the specifics of a given contract and the client's situation. At the customer's request, it is also possible to carry out financial simulations, illustrating the effects of possible cancellation or 'defrancization' of the loan.
