
International protection and refugee status

On the territory of Polish, a foreigner may in particular obtain one of the following forms of protection:
• refugee status – granted to a person who fears persecution in their country of origin because of their race, religion, nationality, membership of a particular social group or political opinion,
• subsidiary protection – granted to a person who does not qualify for refugee status, but if returned to the country would face a real risk of suffering serious harm (e.g. torture, death penalty, threat to life or health resulting from the widespread use of violence against civilians in a situation of international or internal armed conflict).
What is more, if the Border Guard finds that a foreigner is staying in Poland illegally and initiates proceedings against him to oblige the foreigner to return, it is possible to apply in such proceedings for a residence permit for humanitarian reasons or a permit for tolerated stay – these are granted when the foreigner's return to the country would constitute a violation of his human rights, in particular:
• his or her right to life, liberty and personal security would be at risk, or
• he or she could be subjected to torture or inhuman or degrading treatment or punishment, or
• could be forced to work, or
• could be deprived of the right to a fair trial or be punished without legal basis, or
• ordering him to leave Polish would violate his right to family or private life, within the meaning of the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms,
• ordering the child to leave Polish would violate the rights of the child.
